The Surprising Truth: What Truly Motivates Employees?

This lively RSA Animate, adapted from Daniel Pink's talk at the RSA, illustrates the hidden truths behind what really motivates us at home and in the workplace. He also gives some examples of new approaches that modern day companies have created in order to maximize employee capability and business success.

His speech is based on the ideas of his non-fiction book “Drive”, which was published in 2009. In this book, he argues that human motivation is largely intrinsic, and that the aspects of this motivation can be divided into autonomy, mastery and purpose. He argues against old models of motivation driven by rewards and fear of punishment, dominated by extrinsic factors such as money.

Blog Series - Affordable Care Act - The Deadline

The Affordable Care Act continues to dominate the minds of many Americans as the deadline for registration approaches.  As it stands right now, Monday March 31st is the deadline for registration for the ACA, with unregistered individuals facing fines.  Yesterday, the Obama Administration announced that due to a surge in registrations, the deadline will be extended.  But they did not state exactly when the deadline will now be.

Needless to say, people's emotions regarding the Affordable Care Act continue to run high.  Polls indicate that opinions of the ACA are at an all-time low.  With 6 million individuals already registered, and more registering everyday, the news and opinions will continue to pour in, and I will do my best to keep you informed.  While these articles are not specific to Small Business, they will help you know what is currently going on and what is coming next.

Who must be registered for sales tax purposes

If you will be selling property or services in New York State that are subject to sales tax, you may be required to collect the sales tax from the person to
whom you make the sale. In general, the sales tax you must collect and remit is computed using the combined state and local rate in effect in the locality where you deliver the taxable product or service to the customer. If you must collect sales tax on your sales, then you must register for sales tax purposes with the Tax Department and obtain a Certificate of Authority (see How to Register for New York State Sales Tax (TB-ST-360)).

You must also be registered for sales tax purposes to issue or accept most New York State sales tax exemption documents. For example, even though wholesalers may never collect sales tax because all of their purchases and sales are for resale (and, therefore, are eligible for exemption from sales tax), they must still be registered to legally issue and accept most exemption documents. For additional information on who must be registered for sales tax purposes, see Do I Need to Register for Sales Tax? (TB-ST-175).

If you are required to register for sales tax purposes but fail to do so and you engage in business without having obtained a valid Certificate of Authority,
you will be subject to a penalty. The penalty is up to $500 for the first day business is conducted without having obtained a valid Certificate of
Authority, plus up to $200 per day for each day thereafter. The maximum penalty for engaging in business without obtaining a valid Certificate of Authority is $10,000. See Sales and Use Tax Penalties (TB-ST-805).

If you change your organizational structure (for example, from a sole proprietorship to a corporation, a limited liability company, or a partnership), the new organization must register for sales tax purposes and obtain a new Certificate of Authority. The new business must obtain its own Certificate of Authority before it begins operating. You must also file a final return for your existing business and surrender the Certificate of Authority that was issued to the existing business. Support for Windows XP and Office 2003 Ends April 8, 2014

The ASBDC wanted to make sure all small business owners are aware of an important occurrence next month. As of April 8, 2014, Microsoft will no longer provide technical assistance for Windows XP and Office 2003, including automatic updates that help protect your PC. According to Microsoft, more than 20 percent of small businesses are still using the XP platform, which Microsoft first introduced in 2001.

What does this mean for your business?
1. There will be no new security updates, non-security hotfixes, free or paid assisted support options, or online technical content updates.
2. Without critical security updates, PCs could become vulnerable to harmful viruses, spyware, and other malicious software which can steal or damage business data and information.
3. Anti-virus software will not be able to fully protect PCs running Windows XP once the OS is no longer supported.
4. Businesses that continue to run Windows XP after support ends may be exposed to potential security threats, and may even risk breaching compliance standards depending on the industry in which they operate.

How do you stay protected?

To stay protected after support ends April 8, you have two options:
1.Upgrade your current PC: Very few older computers will be able to run Windows 8.1, which is the latest version of Windows. You may want to download and run the Windows Upgrade Assistant to check if your PC meets the system requirements for Windows 8.1 and then follow the steps in the tutorial to upgrade if your PC is able. For more detailed information, read the FAQ.

2.Get a new PC:
If your current PC can't run Windows 8.1, it might be time to consider shopping for a new one. The average price of a PC is considerably less expensive than the average PC was 10 years ago.

Charging sales tax on Internet transactions

From the Sales Tax Institute.

You collect the tax for the state where the property is delivered to your customer. If the item is shipped to the customer, then tax applies for the delivery state. You should collect the tax only if you are registered to collect tax in that state. If the customer picks up the item at your location, tax should be collected for your state.

If you are selling goods over the Internet and your company has a presence in the state of delivery, your company has established nexus and will be required to register to collect sales tax on all taxable items regardless of method of order placement. Whether the order is placed over the Internet or through traditional means, if a company has nexus with the state in which the product is being shipped, sales tax should be billed and collected. For example, if a New York company ships to New York, there is nexus, and tax is collected. If the New York company ships out of New York, whether they collect sales tax or not depends on whether or not they have nexus with the state into which they are shipping.

If the retailer is located out-of-state and does not have a physical location or other type of physical representation in the state [nexus], the state cannot require the retailer to collect their sales tax. However, some out-of-state retailers voluntarily collect the tax as a convenience to their customers. If the retailer does not collect the sales tax, the purchaser has the obligation to pay the use tax directly to the state where the property is used as long as the item is taxable.

Re: out of state and sales tax with no nexus: It is the purchaser’s responsibility to self accrue and remit use tax. There is no sales tax obligation for your company if you have not established nexus.

Have Fun Breaking Down This Year’s Worst Company In America Bracket

(This is useful to think about what NOT to do in business ...)

After going through all of your nominations, [the Consumerist is]... proud to present the first round match-ups for this year’s Worst Company in America tournament!

As you’ll see from the image below, there are several returning competitors, including previous champs EA and Comcast, three-time runner-up (and sort of winner from when it acquired Countrywide) Bank of America, the perennially hated Ticketmaster and PayPal (with their respective corporate counterparts LiveNation and eBay).

There are also some new names on the list, like Koch Industries and lawsuit-happy seed company Monsanto. There’s also SeaWorld making a splash on WCIA 2014, presumably because people have been watching that Blackfish documentary.

Voting will begin tomorrow, March 19. In the early rounds, each match will be open for votes for only a few hours. While they are open, polls will be placed at the top of the Consumerist homepage and in a sidebar slot. We’ll post the results and update the bracket at the end of each day.

When you must pay NYS, local sales or use tax directly to Tax Department?

When you purchase taxable property or services from a seller (vendor) located in New York State and take delivery in New York State, the vendor should collect state and local sales tax due and send it to the Tax Department. However, you are responsible for paying the tax directly to the Tax Department under the following circumstances:

Deliveries into New York State without collection of sales tax

You owe state and local sales tax if you purchase taxable property or a taxable service that is delivered to you in New York State without payment of New York State and local tax to the seller, such as through the Internet, by catalog, from television shopping channels, or on an Indian reservation.

Purchases of property or services outside New York State with subsequent use in New York State

You may also owe New York State and local use tax if you are a resident of New York State at the time you purchase any of the following outside New York State:

• property you bring into New York State for use in New York State;

• a service performed on property outside New York State, and you bring the property into New York State for use here; or

• a service (such as a protective or detective service) provided to you within New York State.

However, you are not required to pay state and local use tax on any property or service performed on property that you purchased outside the state before you became a resident of New York State.

Of course, we had no Internet. What is your Businesses’ Communications Backup Plan


"Every cell tower in the Long Island community stopped working and representatives from wireless companies were nowhere to be found…Schnirman (Long Beach city manager) said he spent a week after the storm trying to persuade a wireless carrier, which he declined to name, to deploy a portable cell tower -- known as a "cell on wheels" -- to restore service in Long Beach.  “We reached out to the carrier’s customer support to ask about getting a cell on wheels and the voice on phone said ‘You might want to look that up on Internet. I don’t know what that is,’” he recalled. “Of course, we had no Internet."(smith 2013)

            “One year after Hurricane Sandy triggered a communications blackout across the country's most populous region, city governments, federal regulators and wireless carriers are still grappling with how to keep cell phones working in a disaster. Phone companies have come under pressure to ensure they can provide service in emergencies, and while they have taken steps to bolster their networks, many question whether it will be enough for the next big storm.

The search for answers has become increasingly urgent as storms grow in strength and frequency and rising numbers of people ditch their landlines. Today, almost 40 percent of households use only cell phones, relying on wireless networks to contact family, friends or 911 in an emergency.

Sandy exposed the weaknesses of wireless in a crisis. With electricity out for days, cell towers ran out of backup power. Sandy knocked out one-fourth of towers in the Northeast, leaving thousands unable to make calls.” “"After Sandy hit, far too many impacted residents struggled to get service because far too many cell towers were rendered inoperable," Sen. Charles Schumer (D-N.Y.) said at a news conference last year. But the wireless industry sued to fight off mandates for longer-lasting battery power after Hurricane Katrina. And today, carriers maintain that their towers have enough backup power and requiring more would be of little use if towers or lines connecting them to the network are damaged in a hurricane.

Instead, the Federal Communications Commission has proposed that carriers be required to publicly disclose how many of their towers stop working after storms. The new rule, if adopted, would help consumers choose which provider is most dependable in severe weather and “shame companies into beefing up their infrastructure,” said Howard Feld, senior vice president at Public Knowledge, a public interest group.”The wireless industry, however, says it has already spent the past year strengthening its networks to ensure cell service after the next hurricane. AT&T, Verizon, Sprint and T-Mobile told The Huffington Post they have taken a variety of measures, investing in more generators and portable cell towers, upgrading cables that connect towers to the network, and expanding capacity so networks don’t jam when millions of people try to make calls at once.

CRISIS COMMUNICATIONS PLAN
When an emergency occurs, the need to communicate is immediate. If business operations are disrupted, customers will want to know how they will be impacted. Regulators may need to be notified and local government officials will want to know what is going on in their community. Employees and their families will be concerned and want information. Neighbors living near the facility may need information—especially if they are threatened by the incident. All of these “audiences” will want information before the business has a chance to begin communicating.” Social media outlets can spread a rumor faster than anyone can decide the truth of a real time situation.

Q: Just when I thought I had it all going on with regard to my website, it turns out that I am now supposed to have a mobile version of my site, right? Is this really necessary? I have more important things to spend my time on, don't you agree? -- T.J.

A. I would like to agree, but unfortunately, I cannot. Consider, just for starters, these statistics I recently saw from Visual.ly:

• Mobile search has grown five times in the past two years.

• 52% of all local searches are done on a mobile phone.

• Nine out of 10 mobile searches end in a purchase.

So, no, you cannot ignore your mobile website; indeed, for most small businesses, it needs to become a priority.

Look, we live in a world where mobile is taking over (or has taken over.) More and more, people are using smartphones and tablets as their main access point for the Web, and that means that sites that are not optimized for mobile devices have a problem.

FTC Increases Deterrence with Stepped Up Enforcement of the Fair Debt Collection Practices Act

Over the last year, the Federal Trade Commission has continued aggressive enforcement of the Fair Debt Collection Practices Act by bringing or resolving nine debt collection cases, according to the agency’s annual summary of debt collection activities.

“When it comes to debt collection, the FTC has many tools in its arsenal, including research, enforcement, and consumer education,” said Jessica Rich, Director of the agency’s Bureau of Consumer Protection. “But in the years since the financial crisis hit, we have increased our emphasis on law enforcement.”

In 2013, the FTC obtained court orders stopping illegal debt collection activities in seven cases, and referred two other debt collection cases to the Department of Justice for civil penalties. In several of the cases, the FTC obtained temporary restraining orders halting the unlawful conduct, freezing the defendants’ assets, and appointing receivers to take over operations while court proceedings progressed.

SBA Expands Outreach for Native Small Business Owners

WASHINGTON – The U.S. Small Business Administration will join the National Center for American Indian Enterprise Development (NCAIED) at its National Reservation Economic Summit (RES) March 17-20, 2014 to sign a strategic alliance memorandum (SAM) to widen reach to Native American entrepreneurs and boost entrepreneurship opportunities.

The National Center for American Indian Enterprise Development (NCAIED) is a 501(c)(3) non-profit organization. With more than 40 years of assisting American Indian Tribes and their enterprises with business and economic development, they have evolved into one of the largest national Indian specific business organizations in the nation.

The 28th Annual National Reservation Economic Summit in Las Vegas, Nev., will feature respected tribal leaders, state and local elected officials and top CEOs, networking, teaming opportunities, business development sessions and American Indian Procurement opportunities.

What Constitutes as Sexual Harassment?

It is unlawful to harass a person (an applicant or employee) because of that person’s sex. Harassment can include “sexual harassment” or unwelcome sexual advances, requests for sexual favors, and other verbal or physical harassment of a sexual nature.

Harassment does not have to be of a sexual nature, however, and can include offensive remarks about a person’s sex. For example, it is illegal to harass a woman by making offensive comments about women in general. Both victim and the harasser can be either a woman or a man, and the victim and harasser can be the same sex.

Although the law doesn’t prohibit simple teasing, offhand comments, or isolated incidents that are not very serious, harassment is illegal when it is so frequent or severe that it creates a hostile or offensive work environment or when it results in an adverse employment decision (such as the victim being fired or demoted).

The harasser can be the victim's supervisor, a supervisor in another area, a co-worker, or someone who is not an employee of the employer, such as a client or customer. Read more on sexual harassment and ways that you can prevent it from occurring in the workplace.

Kickstarter and Taxes: A guide for your accountant.

In general, in the US, funds raised on Kickstarter are considered income.

In general, a creator can offset the income from their Kickstarter project with deductible expenses that are related to the project and accounted for in the same tax year. For example, if a creator receives $1,000 in funding and spends $1,000 on their project in the same tax year, then their expenses could fully offset their Kickstarter funding for federal income tax purposes. If a creator receives funding in one year and spends money on their project in a later year, consider whether their expenses can still offset their Kickstarter funding using the accrual method of accounting.

From one Kickstarter alum: "Approximately 33% of the funding goal goes to pay the state and federal taxes that will be levied against the money raised. American tax law doesn't count up-front production costs as an immediately deductible business expense, so at first I'll have to pay taxes on nearly all of it as if it were pure income." Again, the accrual method may mitigate this.
