California Says Uber Driver is an Employee

It was only a week ago that I saw a request for information on how Uber drivers were defined. This appears in today's New York Times:

The classification of freelancers is in dispute across a number of industries, including at other transportation companies. And the debate is set to escalate as the number of online companies and apps like Uber and others rises. “Today’s ruling from the California labor regulators demonstrates why federal policy makers need to re-examine the 20th-century definitions and employment classification we’re attempting to apply to a 21st-century work force,” said Senator Mark R. Warner, a Democrat from Virginia.

Everyone had to know that the government’s ruling would come out this way. Compare how much money the government gets from Uber or Lyft when drivers are classified as employees vs. contractors. When funds are disbursed via payroll, government gets payroll tax, in addition to other goodies. When funds are disbursed via accounts payable, such as to a contractor, there are fewer taxes.

Beware credit counseling services like Clear Your Debt LLC

An advisor at one of our regional centers asked me to share some information he learned while working with a client last week. During the course of the counseling session, the client revealed she had signed up with a credit counseling service, Clear Your Debt LLC, from Austin, TX. The advisor was concerned when he read the contract the client signed, which prompted him to investigate the company. The Better Business Bureau in Austin told the advisor they had received numerous complaints against Clear Your Debt LLC. Though Clear Your Debt promised financing, counseling and other assistance, the advisor’s conclusion - after reading their confusing contract and talking to the BBB - was that the client would pay $15,000 for basically nothing.
